This Privacy Policy describes how Mina Labs, Inc. ("Particle," "we," "us," or "our") collects, uses, discloses, and protects information about visitors to our public-facing API website (the "Website"). This Privacy Policy applies to all individuals who access or browse the Website.

This Privacy Policy does not apply to the Particle API Services (such as the Podcast Intelligence API or News Intelligence API), which are governed by a separate privacy policy. If you are a registered API customer, please refer to that policy for information about how we handle data collected through your use of the API Services.

By accessing or using the Website, you acknowledge that you have read and understood this Privacy Policy.

2. INFORMATION WE COLLECT

2.1 Information You Provide. We collect information you voluntarily submit through the Website, including through account registration, contact forms, newsletter or mailing list signups, demo requests, and other inquiry forms. This may include: name, email address, company name, job title, phone number, account credentials (such as a password when you create an online account), marketing preferences (such as your preferences for receiving our marketing communications and details about your engagement with them), and any other information you choose to include in your message or submission.

2.2 Information Collected Automatically. When you visit the Website, we and our service providers automatically collect certain technical and usage information, which may include: IP address, browser type and version, device type and operating system, geolocation data (such as city or region inferred from your IP address), referring URL (the page that directed you to our Website), pages visited and content viewed, time spent on pages and clickstream data, and date and time of your visit.

2.5 API Explorer. If you use the API Explorer feature on the Website, we collect information about your interactions with the Explorer, including search queries, filters, content parameters, and other inputs you submit, as well as the content and data returned to you in response. This information may be associated with other data we collect about you under this Privacy Policy, such as your IP address and device information. The API Explorer allows you to interact with Particle's API Services directly through the Website; accordingly, data collected through your use of the Explorer is also subject to the Particle API Services Privacy Policy.

3. HOW WE USE YOUR INFORMATION

We use the information we collect for the following purposes:

(a) Inquiries and Communications: responding to your inquiries, providing information you have requested, and following up on demo requests or other submissions.

(b) Marketing Communications: sending you newsletters, product updates, promotional content, and other marketing communications, subject to your consent where required by applicable law.

(c) Website Analytics: analyzing website traffic, user behavior, and usage patterns to understand how visitors interact with our Website.

(d) Website Improvement: improving the content, design, and functionality of the Website based on how visitors use it.

(i) API Explorer: processing your Explorer queries and returning results, analyzing Explorer usage patterns to improve the Website and the API Services, and enforcing applicable use restrictions and rate limits.

4.1 Categories of Cookies. We use the following categories of cookies and similar technologies on the Website:

Strictly Necessary: These are essential for the Website to function and cannot be disabled. They include cookies that manage user sessions and enable core site functionality.

6. YOUR RIGHTS AND CHOICES

Right to Delete: the right to request deletion of your personal information, subject to certain exceptions.

Right to Correct: the right to request correction of inaccurate personal information.

Right to Opt Out of Sharing: the right to opt out of the "sharing" of your personal information for cross-context behavioral advertising. As noted in Section 5(b), our use of advertising pixels may constitute such sharing. To opt out, please contact us using the information in Section 13 or use the cookie management tool on the Website.

Right to Non-Discrimination: the right not to receive discriminatory treatment for exercising your privacy rights.

7. DATA RETENTION

We retain personal information you submit through the Website for as long as you remain subscribed to our communications and for a reasonable period thereafter. We retain analytics and tracking data in identifiable form for up to thirty-six (36) months. Aggregated, de-identified data may be retained indefinitely. We may retain information longer if required by applicable law or as reasonably necessary to protect our legal rights and interests.

8. DATA SECURITY

We implement commercially reasonable technical and organizational measures to protect the information we collect through the Website against unauthorized access, alteration, disclosure, or destruction.
