Particle Data Platform Services — Privacy Policy

1. INTRODUCTION

This Privacy Policy describes how Mina Labs, Inc. ("Particle," "we," "us," or "our") collects, uses, discloses, and protects personal information in connection with the Particle API Services, including the Podcast Intelligence API, News Intelligence API, and any other API products we make available (collectively, the "API Services"), and the Particle platform located at platform.particle.pro (the "Platform"). This Privacy Policy applies to all individuals and entities that register for an API account, access the Platform, or otherwise interact with the API Services ("you" or "your").

This Privacy Policy does not apply to Particle's consumer-facing website or mobile application, which are subject to a separate privacy policy available at here.

2. INFORMATION WE COLLECT

2.1 Account Registration Information. When you register for an API account, we collect the following information:

  • Name

  • Email address

  • Company name (if applicable)

2.2 Payment Information. We use Stripe, Inc. ("Stripe") as our third-party payment processor. When you provide payment information, Stripe collects and stores your physical address and payment details (such as credit card number and billing information) on its systems. Particle does not directly collect or store your payment card information. Stripe's collection and use of your information is governed by Stripe's privacy policy, available at https://stripe.com/privacy.

2.3 API Usage Data. When you use the API Services, we automatically collect technical and usage information, which may include:

  • API request logs, including endpoints accessed, request parameters, query content (such as search terms, content identifiers, content types, categories, and topics requested), timestamps, response data, and content preferences and usage patterns derived from your API requests

  • API Key identifiers

  • IP address

  • Request volume, frequency, and response times

  • Error logs and response codes

  • User agent, client information, device type, and feature utilization patterns

2.4 Communications. If you contact us for support or other inquiries, we may collect the contents of your communications, including email address, name, and any information you choose to provide.

2.5 Usage Data. Particle may aggregate and de-identify API Usage Data and other information collected in connection with the API Services. Particle owns all right, title, and interest in and to such aggregated, de-identified data ("Aggregated Data"). Particle may use Aggregated Data for any lawful business purpose, including without limitation product improvement, performance optimization, feature development, analytics, benchmarking, and industry reporting. Aggregated Data will not identify you, your company, or any individual user. In addition, Particle may use non-aggregated, identifiable API Usage Data for internal business purposes, including but not limited to: (a) internal benchmarking and performance analysis; (b) analysis of usage patterns across industry verticals, customer segments, and API product categories; (c) product development, feature prioritization, and service improvements; and (d) capacity planning and infrastructure optimization. Particle will not sell or share non-aggregated, identifiable API Usage Data with third parties for their own independent use.

3. HOW WE USE YOUR INFORMATION

We use the information we collect for the following purposes:

(a) Providing the API Services: processing your API requests, managing your API account, authenticating access, and delivering API Output.

(b) Billing and Payments: calculating fees, generating invoices, and coordinating with Stripe for payment processing.

(c) Service Operations: monitoring API performance, diagnosing technical issues, preventing fraud and abuse, enforcing rate limits and usage quotas, and maintaining the security and integrity of the API Services.

(d) Improvement and Analytics: analyzing usage patterns, including in identifiable form for internal benchmarking, vertical and segment analysis, and product development, as well as in aggregated and de-identified form, to improve the API Services, develop new features, and optimize performance.

(e) Communications: responding to your inquiries, providing technical support, and sending service-related notices (such as maintenance windows, policy changes, or security alerts).

(f) Legal Compliance: complying with applicable laws, regulations, and legal processes, and enforcing our API Terms of Service.

4. HOW WE SHARE YOUR INFORMATION

We do not sell your personal information. We may share your information in the following circumstances:

(a) Service Providers: We share information with third-party service providers who perform services on our behalf, including Stripe (payment processing), cloud hosting providers, and analytics services. These providers are contractually obligated to use your information only for the purposes of providing services to us.

(b) Legal Requirements: We may disclose your information if required to do so by law, regulation, legal process, or governmental request, or if we believe in good faith that such disclosure is necessary to protect our rights, your safety, or the safety of others, investigate fraud, or respond to a government request.

(c) Business Transfers: In connection with a merger, acquisition, reorganization, sale of assets, or bankruptcy, your information may be transferred to the acquiring entity or successor.

(d) With Your Consent: We may share your information for other purposes with your express consent.

5. DATA RETENTION

We retain your account registration information for the duration of your API account and for seven (7) years thereafter as necessary to comply with our legal and tax obligations, resolve disputes, and enforce our agreements. API usage data is retained in identifiable form for up to thirty-six (36) months to support billing inquiries, security investigations, service optimization, and dispute resolution. Payment-related records are retained for seven (7) years for tax compliance purposes. Aggregated, de-identified data may be retained indefinitely. Notwithstanding the foregoing, we may retain any information for longer periods if required by applicable law, regulation, or legal process, or as reasonably necessary to protect Particle's legal rights and interests.

6. DATA SECURITY

We implement commercially reasonable technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These measures include encryption of data in transit, access controls, and regular security assessments. No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

7. YOUR RIGHTS AND CHOICES

Depending on your jurisdiction, you may have certain rights regarding your personal information, including:

(a) Access: the right to request a copy of the personal information we hold about you.

(b) Correction: the right to request correction of inaccurate personal information.

(c) Deletion: the right to request deletion of your personal information, subject to certain exceptions (such as retention required by law).

(d) Opt-Out of Communications: you may opt out of non-essential communications by following the unsubscribe instructions in any email or by contacting us directly.

7.1 California Residents. If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), including the right to know what personal information we collect and how we use it, the right to request deletion, the right to correct inaccurate information, and the right to opt out of the sale or sharing of personal information. As noted above, we do not sell your personal information. To submit a request, contact us using the information in Section 11.

7.2 EEA and UK Residents. If you are located in the European Economic Area ("EEA") or the United Kingdom ("UK"), the following additional information applies to you.

Legal Bases for Processing. We process your personal data on the following legal bases: (a) performance of a contract, including to provide the API Services, manage your account, process payments, and fulfill our obligations under the API Terms of Service; (b) our legitimate interests, such as improving the API Services, analyzing usage patterns, ensuring security, preventing fraud and abuse, and conducting internal analytics and benchmarking, provided those interests are not overridden by your data protection rights; (c) your consent, where you have provided it, such as for non-essential communications; and (d) compliance with a legal obligation to which we are subject.

Your Rights. Under the General Data Protection Regulation ("GDPR") and applicable UK data protection law, you have the right to: (a) access your personal data; (b) rectify inaccurate or incomplete personal data; (c) erase your personal data in certain circumstances; (d) restrict the processing of your personal data; (e) data portability, meaning the right to receive your personal data in a structured, commonly used, and machine-readable format; (f) object to processing based on our legitimate interests; and (g) withdraw your consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

Supervisory Authority. You also have the right to lodge a complaint with your local data protection supervisory authority.

8. THIRD-PARTY LINKS AND SERVICES

The API Output may contain links to third-party websites, applications, or content. This Privacy Policy does not apply to any third-party services, and we are not responsible for the privacy practices of any third party. We encourage you to review the privacy policies of any third-party services you access.

9. CHILDREN'S PRIVACY

The API Services are not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 18, we will take steps to delete such information promptly.

10. INTERNATIONAL USERS

The API Services are operated from the United States. If you access the API Services from outside the United States, your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction. Where required by applicable law, we rely on appropriate transfer mechanisms to lawfully transfer personal data, including the European Commission's standard contractual clauses or other safeguards recognized under applicable data protection law. By using the API Services, you acknowledge and understand that your information may be transferred to the United States as described in this Privacy Policy.

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on our website and updating the "Last Updated" date above. Your continued use of the API Services after the effective date of any update constitutes your acceptance of the revised Privacy Policy.
